10-Year-Old Girl Go To Court To Ask For Abortion

A ten-year-old girl who was raped by her stepfather has been forced to go to court to plead for an abortion.

The young child, from Rohtak in the Haryana state of India, is due to give birth in four months, but abortion laws in India could prohibit her from having a termination.

According to reports, the girl's mother discovered she was pregnant and took her to see a doctor. The child then told her parent that she had been repeatedly raped by her stepfather. They had allegedly been left alone together countless times while the girl's mother was at work.

The stepfather has now been arrested and detained in custody while a full investigation is carried out.


In India, abortions are not allowed after 20 weeks, and two separate doctors must be able to certify that the pregnant woman's life would be in danger if she was to give birth.

After 20 weeks, India's Supreme Court must decide if the pregnancy can be terminated.

Dr Ashok Chauhan, medical superintendent at the Post-Graduate Institute of Medical Sciences, said: "The police and the authorities will now take the report to the court which can order whether the child can undergo an abortion."

But he the girl's case was "borderline" and that it was difficult to tell exactly how many weeks pregnant the girl was due to lack of advanced technology.
